Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the PDF-API.io platform, including the website, API, template editors, and all related services (collectively, the "Service"), operated by PDF-API.io, a company registered in Switzerland ("PDF-API.io", "we", "us", or "our").

By creating an account, accessing, or using the Service, you ("User", "you", or "your") agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

PDF-API.io provides a cloud-based platform for generating PDF documents via:

  • A REST API for programmatic PDF generation
  • A drag-and-drop visual editor for designing PDF templates
  • An HTML/CSS code editor with Headless Chrome rendering
  • Template management, team collaboration, webhooks, and third-party integrations (Zapier, Make, etc.)

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including API tokens. You must notify us immediately at hello@pdf-api.io if you become aware of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

4. Subscription Plans and Pricing

4.1 Plans

The Service is available under multiple subscription tiers: a free plan, and paid plans (currently "Basic" and "Pro"). Each plan includes different usage limits for PDF generations per month, number of templates, and access to features as described on our pricing page.

4.2 Free Trial

Paid plans may include a 14-day free trial period. During the trial, you have full access to the plan's features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription, and you will be charged according to the selected billing cycle.

4.3 Billing

Payments are processed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis (monthly or yearly) until you cancel. All prices are in USD unless otherwise stated.

4.4 No Refunds

All subscription fees are non-refundable. This includes partial months, unused PDF generation quotas, and any unused portion of your subscription period. You may cancel your subscription at any time, and your access will continue until the end of the current billing period.

4.5 Price Changes

We reserve the right to modify our pricing at any time. Existing subscribers will be notified at least 30 days before any price change takes effect on their next billing cycle.

5. Usage Limits and Fair Use

5.1 Quotas

Each subscription plan includes a monthly PDF generation quota. When you reach your quota, further generation requests will be declined until the next billing cycle. Unused quotas do not roll over.

5.2 Rate Limiting

API requests may be subject to rate limiting to ensure fair access for all users. We reserve the right to throttle or temporarily restrict access if usage patterns indicate abuse or excessive load.

5.3 Fair Use

You agree to use the Service in a manner consistent with normal business usage. We reserve the right to suspend accounts that engage in activity that negatively impacts the performance or availability of the Service for other users.

6. User Content and Intellectual Property

6.1 Your Content

You retain full ownership of all templates, data, and PDF documents that you create or generate through the Service ("User Content"). PDF-API.io does not claim any intellectual property rights over your User Content.

6.2 License to PDF-API.io

You grant PDF-API.io a limited, non-exclusive, worldwide license to process your User Content solely for the purpose of providing the Service. This license terminates when you delete your content or your account.

6.3 PDF-API.io Intellectual Property

The Service, including its design, code, starter templates, documentation, and branding, is the property of PDF-API.io and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. Data Handling and Privacy

7.1 PDF Generation

By default, generated PDFs are returned directly in the API response and are not stored on our servers. We retain the request payload (template reference and data sent) for the purpose of providing generation logs, enabling you to debug and monitor your usage.

7.2 Optional Storage

We may introduce optional PDF storage features in the future. Such features will be strictly opt-in and subject to their own terms regarding data retention and deletion.

7.3 Personal Data

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR). For details, please refer to our Privacy Policy.

7.4 Your Responsibility

If you transmit personal data of third parties (e.g., client names, addresses, or financial data in invoices), you are the data controller and are responsible for ensuring you have a lawful basis to process such data.

8. Prohibited Use

You agree not to use the Service to:

  • Generate, distribute, or store content that is illegal, defamatory, obscene, or otherwise objectionable under applicable law
  • Create fraudulent documents, including but not limited to forged invoices, counterfeit certificates, fake identity documents, or phishing materials
  • Infringe upon the intellectual property rights of any third party
  • Distribute malware, spam, or engage in any activity that could harm the Service or its users
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems
  • Circumvent usage limits, rate limits, or security measures
  • Resell or redistribute the Service without written authorization

We reserve the right to suspend or terminate your account immediately if we determine that you have violated these prohibitions.

9. Availability and Disclaimers

9.1 Service Availability

We strive to maintain high availability of the Service, but we do not guarantee any specific uptime or service level. The Service may be subject to scheduled or unscheduled maintenance, outages, or disruptions.

9.2 "As Is" Basis

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, PDF-API.io disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.3 No Guarantee of Results

We do not guarantee that the PDFs generated will meet your specific requirements or that rendering will be identical across all environments and use cases.

10. Limitation of Liability

To the maximum extent permitted by Swiss law, PDF-API.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the total fees paid by you to PDF-API.io during the twelve (12) months immediately preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless PDF-API.io, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms or applicable law
  • Your infringement of any rights of a third party

12. Termination

12.1 By You

You may cancel your subscription and close your account at any time through the billing portal. Cancellation takes effect at the end of the current billing period. Upon account deletion, your templates and associated data will be permanently removed.

12.2 By PDF-API.io

We may suspend or terminate your account at any time if you breach these Terms or engage in prohibited conduct. In cases of material breach, termination may be effective immediately without prior notice.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.

13. Modifications to the Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the website and updating the "Last updated" date. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of Switzerland.
